A Will also called a Last Will and Testament is a document where you state who will receive your property and who will manage your estate. In Florida the person who manages the estate is called the Personal Representative.

Florida Signing and Witness Requirements for a Will

In Florida a Will must be signed by the person making the Will and witnessed by two adults who sign in the presence of the signer and in the presence of each other. A notary is not required for the Will itself. A notary is required for the self proving affidavit that makes probate faster and simpler.

Witness rules in Florida

  • Witnesses should be eighteen or older.
  • Witnesses should be disinterested. They should not be heirs or named in the Will.
  • Best practice is to use two independent witnesses. We can supply witnesses with advance notice for a small fee.

What to Bring

  • Valid government photo ID for the person signing the Will. Bring ID for any other signers.
  • Two adult witnesses or request our witness service.
  • The complete Will printed and ready to sign. We can print if you ask in advance.
  • If at a hospital or a senior facility the signer must be alert willing and able to communicate intent.
  • Any extra pages or exhibits that must be attached.
