What is a Power of Attorney

A Power of Attorney lets a person called the principal give permission to another person called the agent to act for them. It is used for money matters, banking, real estate, insurance, and medical decisions.

Common Types of Power of Attorney

  • Durable Financial Power of Attorney. Works even if the principal becomes unable to make decisions.
  • Limited or Specific Power of Attorney. Used for a single task such as a real estate closing.
  • General Power of Attorney. Broad authority for finances and property.
  • Health Care Surrogate or Medical Power of Attorney. Names a person to make medical decisions if you cannot.
  • Real Estate Power of Attorney. Allows an agent to sign for a sale, purchase, or refinance.

Florida Signing and Witness Requirements

Most Power of Attorney documents in Florida must be signed by the principal, witnessed by two adults, and acknowledged before a notary public.

Witness rules in Florida

  • Witnesses must be eighteen or older and should not be parties to the document.
  • For health care surrogate forms at least one witness cannot be a spouse or a blood relative of the principal.
  • Best practice is to use two independent witnesses.

What to Bring

  • Valid government photo ID for the principal. If the agent will sign, bring ID for the agent as well.
  • Two adult witnesses or request our witness service.
  • The complete Power of Attorney document with no blanks in important sections.
  • If at a hospital or a senior facility the signer must be alert willing and able to communicate intent.
  • Any extra pages that must be attached such as exhibits or property descriptions.
